1. That the Māhaki Forest Settlement Trust represents Te Aitanga a Māhaki for the purposes of remedying Te Aitanga a Māhaki’s historical Treaty of Waitangi claims and includes all hapū and marae of Te Aitanga a Māhaki. Specifically, this includes Te Whānau a Kai; Ngāriki, incl Ngāriki Kaipūtahi, and Mangatū; Ngātapa; Pakohai; Rongopai and Te Wainui Marae.​

2. That the initial trustees of the Māhaki Forest Settlement Trust are Pehimana Brown, Patricia Fleming, Alan Haronga and Robyn Rauna.​

​3. That the Māhaki Forest Settlement Trust has the mandate to:

1) Seek binding recommendations from the Waitangi Tribunal for the return of the Mangatū Crown forest licensed land and associated compensation to the Māhaki Forest Settlement Trust; 

2) Negotiate with the Crown the settlement of all Te Aitanga a Māhaki’s historical Treaty of Waitangi claims (including supporting existing claimants to lead the non-Mangatū forest claims negotiations for their specific claimant group); 

3) Establish, through beneficiaries of Te Whānau a Kai, a mandated Te Whānau a Kai entity to receive all Te Whānau a Kai settlement redress.

4) Establish, through beneficiaries of Ngāriki Kaipūtahi, a mandated Ngāriki Kaipūtahi entity to receive all Ngāriki Kaipūtahi settlement redress.

4. That Te Aitanga a Māhaki supports the agreement between Te Aitanga a Māhaki Trust and The Proprietors of Mangatū Blocks Incorporated (that was ratified in March 2020) and requires the return to the incorporation the Crown forest licensed land that was formerly part of Mangatū No 1 block (known as the 1961 land), along with associated accumulated rentals, New Zealand Units, and compensation of $10million.

5. That the Māhaki Forest Settlement Trust will distribute to the mandated Ngāriki Kaipūtahi entity:

1) A cash payment amounting to 8% of the Mangatū Crown forest resumption compensation (as determined by the Waitangi Tribunal under Schedule 1 of the Crown Forest Assets Act 1989).  Any Te Aitanga a Māhaki Treaty of Waitangi settlement financial redress will also be paid at 8%; 

2) Land in the Mangatū No 2 portion of the Mangatū Crown forest land equivalent to 8% of the value of the total Mangatū Crown forest land.  This distribution will include the relevant accumulated rentals and New Zealand Units that go with the land;

3) The opportunity to acquire land (in lieu of financial compensation) in the Mangatū No 2 portion of the Mangatū Crown forest equivalent to 20% of the value of the total Mangatū Crown forest.  This acquisition will include the relevant accumulated rentals and New Zealand Units that go with the land.

6. That the Māhaki Forest Settlement Trust will distribute to the mandated Te Whānau a Kai entity:

1) A cash payment amounting to 20% of the Mangatū Crown forest resumption compensation (as determined by the Waitangi Tribunal under Schedule 1 of the Crown Forest Assets Act 1989).  Any Te Aitanga a Māhaki Treaty of Waitangi settlement financial redress will also be paid at 20%

2) A cash payment equivalent to 20% of the value of the total Mangatū Crown forest land.
